These Terms of Service ("Terms") govern access to YieldCall, operated by YieldCall at https://yieldcall.com. By creating an account, purchasing credits, or using the service, you agree to these Terms.
This document is a general template for the YieldCall marketing site and service. It is not legal advice. Have qualified counsel review before relying on it.
YieldCall is a software intelligence platform for pay-per-call operators. It provides call transcription and analysis, operational dashboards, ping and bid intelligence, alerts, and optional integrations with systems such as Ringba, HubSpot, Asana, and Slack.
YieldCall does not route calls, terminate telecommunications, or act as a lead seller or buyer. We are not a law firm and do not provide legal, compliance, or tax advice.
You must be at least 18 years old and authorized to bind your organization. You are responsible for safeguarding credentials, activity under your account, and accurate account information.
You are solely responsible for compliance with all laws applicable to your call traffic and use of YieldCall, including but not limited to:
You represent that you have all rights and consents necessary to provide call recordings, metadata, and related data to YieldCall for processing. You will provide required notices to callers, agents, and other parties as applicable.
AI-generated dispositions, summaries, and red-flag signals are assistive tools only. You must review outputs before relying on them for billing, compliance, or operational decisions.
You may not:
Pricing, Intelligence Credits, plan features, and billing terms are described on our website and checkout flows. Fees are generally non-refundable except where required by law or expressly stated. We may change pricing with notice for renewal periods.
Failure to pay may result in suspension of processing, platform access, or integrations.
Integrations with Ringba, HubSpot, Asana, Slack, Stripe, and other providers are subject to their terms. We are not responsible for third-party outages, API changes, or data handling outside our control.
We retain all rights in the service, software, and branding. You retain rights in your data. You grant us a limited license to host, process, and display your data solely to provide and improve the service.
Each party will protect the other's confidential information using reasonable care. We implement security measures described in our Privacy Policy but cannot guarantee uninterrupted or error-free operation.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You will defend and indemnify us against claims arising from your call traffic, your failure to obtain required consents, your violation of law, or your breach of these Terms, except to the extent caused by our gross negligence or willful misconduct.
Either party may terminate according to the applicable plan or agreement. We may suspend or terminate access for non-payment, risk to the platform, or material breach. Upon termination, your right to access the service ends; export obligations and retention limits apply as stated in your plan.
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. Exclusive jurisdiction and venue for disputes will be in courts located in Delaware, unless otherwise required by applicable law.
We may modify these Terms by posting an updated version. Continued use after the effective date constitutes acceptance of material changes where permitted by law.
